Sec. 4 &#8211; Punishment</p>
<p>Bail and Preventative Detention</p>
<p>Bail is a sum of money that the accused may be required to deposit with the court as a guarantee that he or she will appear in court.<br />
The Constitution does not guarantee that all accused persons are entitled to bail, just that the amount of the bail cannot be excessive.</p>
<p>Bail is assigned on the type of crime committed and the likelihood that the accused will return for their trial. The greater the seriousness of the crime, the higher the bail.</p>
<p>Bail allows time for the accused to prepare for their defense, which is hard to do while in jail.<br />
Many people accused of a crime do not have the money for bail so they get a bail bondsman. The bondsman provides the money for bail (for a fee), and may send a bounty hunter to find the bailee if they &#8220;skip&#8221; town and don&#8217;t show up for their trial, which causes the bail bondsman to lose money.</p>
<p>Cruel and Unusual Punishment<br />
The 8th Amendment also forbids “cruel and unusual punishment.” The Supreme Court extended the provision to the States in Robinson v. California, 1962.</p>
<p>The 8th Amendment is intended to prevent, in the Court’s opinion, barbaric tortures such as drawing and quartering and other excessively cruel punishments.</p>
<p>The Supreme Court held that defining narcotics addiction as a crime, rather than an illness, was cruel and unusual in Robinson v. California, 1962. In Estelle v. Gamble, 1976, it ruled that a prison inmate could not be denied medical care.<br />
However, generally the Court has not found many punishments to be cruel and unusual.</p>
<p>Capital Punishment<br />
The Supreme Court voided capital punishment laws in the early 1970s because it felt that the punishment was applied “capriciously” to only a few convicts, often African American or poor or both.</p>
<p>However, in 1976, the Court held for the first time that a new law which instituted the death penalty was NOT unconstitutional. The new law provided for a two-stage trial process.<br />
One trial would determine guilt or innocence, and a second hearing would decide whether the death penalty was warranted.<br />
The Court later restricted the use of the death penalty to cases where the victim died.</p>
<p>Treason is the only crime defined in the Constitution.<br />
Treason is:<br />
1. Levying war against the United States or<br />
2. Giving aid and comfort to the enemies of the United States.<br />
A person can only commit treason in times of war, and it is punishable by the death penalty.<br />
Other related acts, such as sabotage or espionage, can be committed in peacetime.</p>

<p>By 1797, Napoleon Bonaparte felt that Europe offered too few chances for glory. Setting his sights toward Africa in 1798, he invaded Egypt, a province of the Ottoman empire.<br />
“Europe is a molehill. . . . We must go to the East. . . . All great glory has been acquired there.”</p>
<p>Stresses in Muslim Regions<br />
Muslim lands extended from western Africa to Southeast Asia. In the 1500s, three giant Muslim empires ruled much of this world— Ottomans in the Middle East,<br />
Safavids (sah fah vidz) in Persia<br />
Mughals in India.<br />
Empires in Decline<br />
By the 1700s, all three Muslim empires were in decline. Corruption was widespread.<br />
In the 1700s and early 1800s, reform movements sprang up across various Muslim regions of Africa and Asia. Usman dan Fodio led the struggle to reform Muslim practices in northern Africa.<br />
In the Sudan, Muhammad Ahmad (ahk mud) announced that he was the Mahdi (mahk dee), the long-awaited savior of the faith. The Mahdi and his followers fiercely resisted British expansion into the region.<br />
Another Islamic reform movement, the Wahhabi (wah hahb ee) movement in Arabia, rejected the schools of theology and law and wanted to recapture the simplicity of Muhammad’s original teachings.<br />
Through diplomacy and military threats, European powers won treaties giving them favorable trading terms. They then demanded special rights for Europeans residing in Muslim lands. At times, European powers protected those rights by intervening in local affairs.</p>

They reorganized the bureaucracy and system of tax collection. They built railroads, improved education, and hired Europeans to train a modern military. Young men were sent to the West to study science and technology. Many returned with Western political ideas about democracy and equality.<br />
The reforms also brought improved medical care and revitalized farming. These improvements, however, created a different set of problems. Better healthcare resulted in a population explosion that increased the already intense competition for the best land and led to unrest.</p>

The Muslim Turks accused Christian Armenians of supporting Russian plans against the Ottoman Empire. When Armenians protested repressive Ottoman policies, the sultan had tens of thousands of them slaughtered. Russia wanted to protect its southern frontier and expand into Central Asia. Britain wanted to protect its interests in India.<br />

Section 3: European Claims in Muslim Regions</p>
<p>By 1797, Napoleon Bonaparte felt that Europe offered too few chances for glory. Setting his sights toward Africa in 1798, he invaded Egypt, a province of the Ottoman empire.<br />
“Europe is a molehill. . . . We must go to the East. . . . All great glory has been acquired there.”</p>
<p>Stresses in Muslim Regions<br />
Muslim lands extended from western Africa to Southeast Asia.<br />
In the 1500s, three giant Muslim empires ruled much of this world—<br />
Ottomans in the Middle East,<br />
Safavids (sah fah vidz) in Persia<br />
Mughals in India.</p>
<p>Empires in Decline<br />
By the 1700s, all three Muslim empires were in decline. Corruption was widespread.<br />
In the 1700s and early 1800s, reform movements sprang up across various Muslim regions of Africa and Asia.</p>
<p>Usman dan Fodio led the struggle to reform Muslim practices in northern Africa.<br />
In the Sudan, Muhammad Ahmad (ahk mud) announced that he was the Mahdi (mahk dee), the long-awaited savior of the faith. The Mahdi and his followers fiercely resisted British expansion into the region.</p>
<p>Another Islamic reform movement, the Wahhabi (wah hahb ee) movement in Arabia, rejected the schools of theology and law and wanted to recapture the simplicity of Muhammad’s original teachings.</p>
<p>Through diplomacy and military threats, European powers won treaties giving them favorable trading terms. They then demanded special rights for Europeans residing in Muslim lands. At times, European powers protected those rights by intervening in local affairs.</p>

Section 3- Freedom of Speech and Press<br />
According to the Bill of Rights, can you say whatever you want?</p>
<p>The Free Exchange of Ideas<br />
 	Freedom of Speech and Freedom of Press guarantees are meant to:<br />
•	Protect each person’s right of free expression, whether spoken, written, or communicated in any other way.<br />
•	Protect all persons’ right to a complete discussion of public affairs.<br />
 	Freedom of Speech and Press do not protect:<br />
•	Libel, the false and malicious use of written words<br />
•	Slander, the false and malicious use spoken words<br />
•	Obscenity<br />
•	Words that incite others to commit crimes<br />
Seditious Speech<br />
 	Congress has enacted three major laws to prevent sedition and seditious speech:<br />
•	The Alien and Sedition Acts—made scandalous or false criticism of the government illegal.  Expired before Thomas Jefferson took office in 1801.<br />
•	The Sedition Act of 1917—made it a crime to encourage disloyalty or spread anti-government ideas during a time of crisis. Upheld by the Supreme Court in instances of “clear and present danger.”<br />
•	The Smith Act of 1940—forbade advocating violent overthrow of the government, and belonging knowingly to any group that does.<br />
Prior Restraint<br />
In most cases, the government cannot curb ideas before they are expressed. It can punish ideas after they are expressed.<br />
The Media<br />
Symbolic Speech<br />
•	Symbolic speech is expression by conduct.<br />
•	Picketing, the patrolling of a business site by workers on strike, is a prevalent form of symbolic speech.<br />
•	Supreme Court rulings show that the blanket of symbolic speech covers only so much.  It does not cover destroying draft cards (United States v. O’Brien, 1968) but it does encompass flag burning (Texas v. Johnson, 1989, and United States v. Eichman, 1990).<br />
Commercial Speech<br />
•	Commercial Speech is speech for business purposes, usually advertising.<br />
•	Government can forbid advertising that is neither false nor misleading.</p>
<p>Chapter 19 &#8211; Civil Liberties: First Amendment Freedoms<br />
Section 4 &#8211; Freedom of Assembly and Petition<br />
The Constitution’s Guarantees<br />
The Constitution guarantees “…the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.”</p>
<p>So what does it allow you to do without getting arrested?<br />
•	The right to assemble, or gather with one another to express views.<br />
•	The right to bring views to the attention of public officials.<br />
Time-Place-Manner Regulations<br />
The government can make and enforce rules regarding the time, place, and manner of assemblies.<br />
The rights of assembly and petition do not give people a right to trespass on private property.<br />
•	States can interpret their constitutions to require owners of private property, such as shopping centers, to allow people to petition on their property.<br />
Freedom of Association<br />
•	The guarantees of freedom of assembly and petition include a right of association—the right to associate with others to promote causes.<br />
•	The freedom of association also means that a State cannot force an organization to accept members when that association would contradict what the organization believes in.<br />
•	The Supreme Court has ruled that Boy Scouts of America can exclude gays from its organization.</p>
